GENERAL CONDITIONS OF SALE

 

These terms and conditions of sale govern the contractual relationship between Francesco Calabrese's Intimando (hereinafter "INTIMANDO"), with registered office in Italy, in Via San Nicola 10, 84080, Pellezzano (Sa) and the Client (hereinafter "CLIENT") having as its object the sale of products marketed by INTIMANDO through the website www.intimando.com (hereinafter "SITE").

The CUSTOMER is obliged to read carefully these general terms and conditions of sale before submitting their purchase order. The forwarding of the purchase order implies the full knowledge and express acceptance of the aforementioned general conditions of sale.

The CUSTOMER may request information, send communications or make complaints by contacting the customer service of INTIMANDO by sending an email to info@intimando.com.

 

PURCHASES ON THE SITE

 

Purchases on the site can be made:

 

     by order placed on the SITE, by email or telephone;
     exclusively for adults;
     without mandatory registration, but optional;
     ensuring that the personal information provided is complete and truthful;
 

INTIMANDO reserves the right not to accept orders whose information is not complete or from CLIENTS who have in the past violated the conditions of this contract and / or who do not give sufficient guarantees of solvency and / or have previously had an incorrect behavior or for any other reason considered valid by INTIMANDO; everything is always and only at the discretion of INTIMANDO.

It will be up to INTIMANDO to notify the CLIENT via e-mail of any refusal of the order and the subsequent reimbursement if the latter had already paid.

At Intimando's discretion, orders over € 200 may not be accepted. We advise in this case to contact us first at info@intimando.com to agree on the payment method.

 

PURCHASES FROM ABROAD

 

You can ship to the countries listed in the "Shipping" section with shipping costs. For foreign countries it is not possible to pay with the cash on delivery method.

BILLING

E-commerce (online stores) that make indirect sales (through delivery by the courier) like ours, are exempt from issuing invoices, receipts or tax receipts. (Article 22, paragraph 1, No. 1) of Presidential Decree no. 633/72 and art.2, of the Presidential Decree n. 696/1996).

Therefore, an invoice will be issued only for those CUSTOMERS who enter the tax code and / or VAT number when registering personal data. The invoice will always be available in your account or at the link we send via email, to be downloaded and printed. The CUSTOMER can however request that it be included in the package.

PRICES

All prices shown on the site are already inclusive of VAT at 22%.

Product prices and shipping and delivery costs may vary without notice. The CUSTOMER must therefore always check the final sale price before placing an order.

All products are shipped directly from Italy. The prices of the Products and the shipping and delivery costs indicated on the website and in the order, unless otherwise specified, are to be considered not inclusive of any costs related to customs duties and related taxes if the shipment takes place in non-EU countries or in countries where the current legislation provides for import charges.

 

SHIPMENTS - 1. Italy

The shipments are entrusted to the courier Bartolini (BRT), which guarantees delivery within 24/48 working hours. They are free for all orders from € 50.00 upwards (value of products purchased); below this cost their cost is € 5.90.

The CLIENT is required to indicate in the "notes" section during the purchase phase, any information that may be useful to the courier if necessary (eg directions, name on the intercom if different from the customer, internal, scale, delivery c / or different surname or company etc.).

All orders placed before 1pm will be shipped the same day (an email will be sent after shipment, usually before 4pm), otherwise the next business day.

The CUSTOMER can constantly have information about the status of his shipment thanks to the tracking system (by requesting the shipment number by e-mail) and the BRT courier allert, which will notify the customer of the custody of the package for shipment and will indicate via cellular the scheduled time slot in which the parcel will be delivered. For this reason we advise our customers to register a mobile number when ordering.

The courier makes 2 delivery attempts before placing the parcel in storage. Usually leaves a ticket with written directions to request delivery at the same address or different address and time desired. In any case, the customer is not charged additional costs of storage or withdrawal and our customer support is always support to ensure delivery of the package in the shortest possible time and then, if necessary, the release of the package from stock within 24 / 48 hours. In the event that the courier can not deliver the package after 3 attempts or rejection of the recipient, the order will be canceled and the package will return to the sender. Any refund, which will be subtracted the costs of return (€ 9.00) and storage (€ 4.00), will be made within 24/48 working hours.

All packages are insured by total theft or loss; the insurance does not cover cases in which the CLIENT accepts a package that is obviously open or with signs of tampering, in this case the CLIENT is invited to refuse the package, only in this way it will be possible to proceed with the reimbursement. Cash on delivery is a method of payment that always entails (even for orders over 50 €) an additional charge to be paid by the CUSTOMER of 5.00 €.

At Intimando's discretion, orders over € 200 may not be accepted. We advise in this case to contact us first at info@intimando.com to agree on the payment method.

In times of high demand (eg December) delivery may be delayed (1-2 days) not dependent on INTIMANDO, but by the courier.

The public holidays, in which no shipments will be carried out, are the following:

Any other periods during which the parcels will not be sent, will be communicated on the SITE (eg on large slides, when ordering in the section dedicated to the courier).

Shipping is made by DPD that deliver in 3 - 5 working days. There are no thresholds beyond which shipping is free, so you always pay and is at the cost indicated next to each country. For shipments to be made in different countries, please contact us by email at info@intimando.com.

In the event that the CLIENT, for any reason, causes the stock of the parcel and does not respond to our reminders within 24 hours, we will recall the parcel and refund the order by subtracting the storage costs of € 6 + € 4 per storage day + roundtrip shipping costs (= 2 shipping costs depending by price paid for shipping of your country) or 4 € storage for shipments to Italy plus roundtrip shipping.

All costs resulting from failure to deliver the package (wrong address, absence of the recipient and any other reason), are charged to the CUSTOMER.

TERMS OF PAYMENT

 

The payment methods accepted are:

 

     PAYPAL AND CREDIT CARDS (prepaid and non): this is a secure and fast payment method that must be made directly on the SITE at the end of the order creation process;
     ADVANCED BANK TRANSFER: it is a slower payment that requires timing that depends on the banking institutions involved. INTIMANDO will send the purchased goods as soon as the amount has been credited to their current account; the data necessary for the bank transfer will be communicated at the time of the order. In the event that INTIMANDO does not receive the amount due within 7 days, the order will be canceled after informing the customer of the email he provided during the purchase. INTIMANDO, in the latter case may also decide not to receive more orders from the same CLIENT and / or deactivate the account and / or in some way prevent it from making new purchases in the future.
     MARK (ONLY FOR ITALY): payment must be made in cash upon receipt of the ordered goods. The cost of the mark is € 5.00 and is charged to the CUSTOMER.
 

PRODUCTS INTEGRITY

 

All products are shipped in their original packaging as they come to INTIMANDO.

INTIMANDO reserves the right to open the packages before sending them to customers to verify that the object is the one corresponding to the one ordered and to carry out a quality control.

AVAILABILITY OF PRODUCTS

 

The availability of products is always indicated on their sheet. In the exceptional case of purchase of a product temporarily unavailable, INTIMANDO will send an email within 1 working day indicating the time necessary for the return of the product and its shipment; at this point the CUSTOMER can confirm the order or not and in the latter case he will be reimbursed as soon as possible any sum paid.

 

IMAGES AND DESCRIPTIONS OF THE PRODUCTS

 

All images and descriptions of the products on the SITE reproduce and describe as accurately as possible the real characteristics of the products and are protected by copyright.

However, we recommend to consider the photographs as indicative of both the object and the colors of the object itself, as it depends on variables such as the monitor and its settings, the inclination of the same, the photographic devices used and the effect of a non-optimal light presence both during photo production and during visualization.

GOODS PURCHASED NOT ARRIVED OR INCORRECT

If the goods purchased by the CUSTOMER did not arrive, be late or wrong, the CLIENT can write to info@intimando.com indicating their problem. INTIMANDO undertakes to settle this situation at its own expense.

 

RIGHT OF WITHDRAWAL

Return is always possible within 14 days of receipt of goods.
The cost is charged to the customer for € 7.90, due to the courier charge of € 5.90 shipping cost + € 2 commission to collect the package, so we advise our customers to ask, via email ad info@intimando.com, all the useful information you need on sizes and wearability of products, so as to avoid the return itself, the cost of which is greater than many items that we sell and would not be convenient.

 

The CUSTOMER can therefore avail himself of withdrawing from the contract pursuant to Legislative Decree 21/2014 of the Consumer Code.

INTIMANDO allows you to withdraw within 14 working days from the time of receipt of the goods purchased or even before the goods have been delivered and without any justification by communicating via email to info@intimando.com the desire to withdraw from the contract of sale, by filling out the following form, which the CUSTOMER can find inside the package, request by email or download by saving the image below:

The costs of returning the goods are charged to the CUSTOMER.

 

Regarding shipments to Italy, in the case of goods delivered, will proceed INTIMANDO to the reservation of the collection of goods to be returned by BRT courier at a cost of € 7.90 (including shipping cost + € 2 reservation fee to be recognized to the branch BRT which carries out the withdrawal), otherwise for orders refused to the courier, ie without being actually delivered and for which the CLIENT asks for the withdrawal, the cost of return is always € 7.90. In both cases, € 7.90 will be deducted from the refund.

To minimize the possibility of making a return, INTIMANDO invites you to ask via email all the necessary information (wearability, measurements in cm, etc.) related to the items you want to buy. We will reply with all the information requested within the same working day.

As far as foreign shipments are concerned, it will be up to the CUSTOMER and always at his expense, to proceed with the shipment of the items to be returned.

INTIMANDO will proceed to the reimbursement of the payment made by the CUSTOMER for the purchase of the goods and any shipping costs paid as soon as possible and in any case no later than 14 days from receipt of the communication by the CLIENT via email of the occurred shipment.

It is therefore good to distinguish between postage and return costs:

shipping costs are those expenses incurred for the purchase of products and for sending the package to the CUSTOMER and, in the case of return, will always be reimbursed;

the return costs are those expenses incurred to send the package back to INTIMANDO and are charged to the CUSTOMER.

INTIMANDO can withhold the reimbursement until it has received the goods or until the consumer has shown that he has returned the goods, whichever situation occurs first.

INTIMANDO is not obliged to reimburse the additional costs if the CUSTOMER has expressly opted for a type of delivery different from the less expensive type of standard delivery offered by INTIMANDO.

INTIMANDO reimburses using the same payment method used by the consumer for the initial transaction, unless the CUSTOMER has expressly agreed otherwise and on condition that the latter does not incur any cost as a consequence of the reimbursement.

In order for the CLIENT to use the right of withdrawal, it is necessary that:

         the returned Products are returned in their entirety and not on parts or components of them even in the case of kits;
         the returned Products have not been used, worn, washed or damaged;
         the returned Products are returned in their original packaging;
         the returned Products are sent to the Seller in a single shipment. The Seller reserves the right not to accept products of the same order returned and sent at different times;
 

The Right of withdrawal can not be applied in the case of personalized products upon explicit request of the CLIENT at the time of insertion of the Order.

Size and / or item substitutions

In case of replacement of sizes or articles, the return procedure is followed. The return costs are charged to the CUSTOMER for € 7.90, including € 5.90 shipping costs and € 2.00 booking fee for collection to be paid to the BRT branch that performs it. You will need to send us an email to info@intimando.com; we will book the collection for the next business day.

As soon as you arrive, the returned items, at our warehouse, we will issue a discount code, reduced by € 7.90, with which you can make a new order with any other item or size you want.

 

WARRANTY

 

The Seller is responsible for any defect in the products offered on the site, including the non-compliance of the items with the products ordered, in accordance with the provisions of Italian law.

This warranty is valid for 24 months from the date of delivery of the products.

The CLIENT is obliged to file a claim by e-mail and return the defective goods.

INTIMANDO will proceed to reimburse both the costs incurred for the purchase of the product and the return, as soon as the CUSTOMER will notify you via email attaching a photocopy of the invoice.

In this case, the CLIENT may request that the goods be replaced with shipping costs charged to INTIMANDO or cancel the sales contract.

 

REPLACEMENTS AND CHANGE OF GOODS

 

The CUSTOMER can replace the purchased goods following the return procedure and placing a new order.

 

JURISDICTION

Under the law n. 50 of 15.01.1991, the competent court for any dispute is that of the place of residence or domicile of the purchaser.
If the buyer does not have residence, domicile or residence of the State, the competent court is the judicial authority of Salerno. The Court of jurisdiction for disputes concerning payments is the judicial authority of Salerno.

EXTRA-JUDICIAL PROCEDURES OF WHICH THE CUSTOMER CAN SERVE

According to article 49 paragraph 1 letter V of Legislative Decree 6 September 2005 n. 206 (Consumer Code) the customer can use the Joint Conciliation procedure. The Procedure can be initiated if the consumer, after filing a complaint with the company, within thirty days, has not received a response or has received a response that is not considered satisfactory by him.
